Privacy Policy

Your privacy is important to us at Chipper Fox, LLC.  This Privacy Policy explains what information we collect from you when we interact with you, why we collect it, how we use it, and when we may share it with others.  By using our website, www.kimberfoxmorgan.com, and other platforms, you agree to abide by our Privacy Policy.

This Privacy Policy was last updated on June 16, 2021.  We may update it further from time to time by posting the updated version here.  We will not make any substantial change in how we handle personal information we have collected from you without notice and (if the law requires it) your consent.  You are responsible for reviewing any updated version of the Privacy Policy.

What data we collect and why we collect it

We collect information from and about you so that we can provide you with our products and services and offer you the best possible experience when you interact with us.  We may use this information to set up and maintain accounts for you; to communicate with you about our products, services, and other items that we think will interest you; to solicit your opinions and feedback; to personalize your experience when you interact with us; and to help us get the word out about our products and services more effectively.

Specifically, we may collect: your contact information, including your name, address, telephone number, and email address; your log-in or sign-on information; and other ordering information, including shipping and payment information.  We may collect information that allows us to confirm that you are the parent or legal guardian of your child (for more on this, please see “Children’s Privacy,” below).  We may collect information you provide to us when you respond to surveys, provide reviews, make comments, or post user-generated content (such as pictures, videos, and text) to our website or other platforms, including, for example, information about your interests and your demographics.  (If you upload images to our website, you should avoid uploading images with embedded location data (EXIF GPS) included, because visitors to the website can download and extract any location data from images on the website.)

We collect some information automatically when you visit our website, such as information about your device and about the network you are using to access our site.  Other automatically collected information is used to help us better understand who visits our site.

Cookies

A “cookie” is a small file saved on your computer or mobile device when you visit our website.  We use cookies and other similar technologies such as pixel tags and web beacons or clear GIFs to collect certain information automatically.  These technologies help us provide a better experience to you when you visit by managing accounts and access to features on our website, storing your preferences and settings, and offering you personalized content.  Cookies also help us market our services to you.  You may turn off cookies through your Internet browser, but please be aware that if you do so, you may not be able to access some features on our website.

If you leave a comment on our site you may opt-in to saving your name, email address, and website in cookies.  These are for your convenience so that you do not have to fill in your details again when you leave another comment.  These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies.  This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices.  Login cookies last for two days, and screen options cookies last for a year.  If you select “Remember Me”, your login will persist for two weeks.  If you log out of your account, the login cookies will be removed.

Content from other websites

Our website may include links to other websites.  When you use a link to visit another website, your use of that site will be governed by that site’s privacy policy.  We are not responsible for other website hosts’ or sponsors’ privacy practices and policies.  When you link to another website from ours, please be sure to review that website’s privacy policy.

Our website may also include embedded content (such as videos, images, articles, and the like) from other sites.  Embedded content from other websites behaves in the same way as if the visitor has visited the other website.  These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

‘Do Not Track’ signals

We do not track our customers over time and across third-party websites to provide targeted advertising, and therefore we do not respond to Do Not Track (“DNT”) signals.  Some third-party sites do keep track of your browsing activities when they serve you content, however, so that they can tailor what they present to you. If you are visiting such sites, your web browser may allow you to set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked.

How and with whom we may share your information

We may share your information with our third-party partners for a variety of functions, including helping us manage transactions, process and fill orders and requests, maintain the security and effectiveness or our website and other platforms, and help us market our products and services more effectively.  Information about these third-party partners is provided below:

Our website is hosted by Bluehost, a subsidiary of The Endurance International Group, Inc. (“Endurance”), which helps small businesses establish and build their web presence.  Information on Bluehost’s privacy policy (governed by Endurance’s privacy policy) is available at https://www.endurance.com/privacy/privacy.

Our newsletter mailing lists are managed by Mailchimp, an email marketing service.  Information on Mailchimp’s data security and privacy protection practices is available at https://mailchimp.com/about/security/.

To help us manage product purchases, we use WooCommerce, an open-source eCommerce platform (although user data for purchases is stored on our website).  Information on WooCommerce’s privacy policy is available at https://automattic.com/privacy/.

We accept payments through Stripe, Inc. (“Stripe”) and PayPal, Inc. (“PayPal”) platforms that accept online payments.  Information on Stripe’s privacy policy is available at https://stripe.com/us/privacy.  Information on PayPal’s privacy policy is available at https://www.paypal.com/us/webapps/mpp/ua/privacy-full.

We provide shipping through United Parcel Service of America, Inc. (“UPS”).  Information on UPS’s privacy policy is available at https://www.ups.com/us/en/help-center/legal-terms-conditions/privacy-notice.page.

When you leave comments on our site, we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.  An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available at https://automattic.com/privacy/.  After approval of your comment, your profile picture is visible to the public in the context of your comment.

In addition, we may disclose your information when we reasonably believe that we are required to do so by law or in response to a legal request or subpoena, when we need to do so to enforce this Privacy Policy, or when we need to do so to prevent harm to us or to others.  If we become involved with a merger or other situation involving the transfer of some or all of our business assets, we may share your information with business entities or people involved in the negotiation or transfer.  We may disclose your information in any other way we may describe when you provide the information, or for any other purpose with your consent.

Children’s Privacy

We take extra care to protect the privacy of children (defined by the Children’s Online Privacy Protection Act “COPPA” as anyone younger than 13.)  We do not collect personal information from children without the consent of a parent or legal guardian (with certain exceptions, explained below). We do not ask for more personal information from children than is necessary for them to participate in an activity.  We take precautions to prevent children from posting personal information without the consent of a parent or legal guardian, by monitoring posts.

We may ask children to register in order to participate in contests, games, or clubs, and this may require them to provide some personal information, such as a first name only and an email address.  If we need anything more than that, we may ask your child for your email or mailing address, so that we can notify you of your child’s request to participate and get your consent.  In that case, we will tell you what the information your child provides will be used for, how you can review the information, and (if you wish) how you can instruct us to delete it.  If you consent to their participation, however, we may request and maintain whatever other information is necessary for that, such as the child’s last name and address.

The exceptions to our collecting limited personal information before you provide consent follow:

If children ask us a question via email, we will keep their email address long enough to respond to them.

If children sign up for an activity or service (such as a newsletter) that requires multiple communications with them, we will ask them for your email address so that we can notify you and give you the option to opt out of the activity or service.

If children register for an activity (such as a contest), we will ask them for your email address so that we can notify you that they have done so and give you the option to opt out of the activity.  If we need more information to have them participate in the activity, we will explain what we need and why and ask that you provide the information.  We will delete all such information after the activity ends and any period for which the law requires us to keep the information ends.

We may ask for information that is not personally identifiable, such as birthdates, gender, city and state of residence, and interests, to help us provide the products and services best suited to you and your child.

How long we retain your information

Generally, we retain your information only for as long as necessary to fulfill the purposes for which you provided it.

If you leave a comment, the comment and its metadata are retained indefinitely, so that we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For any users who register on our website, we store the personal information they provide in their user profile. All users can see, edit, or delete their personal information (except their user name) at any time. Website administrators can also see and edit that information.

How we protect your information

We know how important your personal information is to you, and we take seriously our responsibility to safeguard any information you provide to us. To protect any personally identifiable information we collect, we have instituted strict measures to prevent unauthorized access to, or disclosure of, your information.  We maintain secure data networks protected by industry-standard firewalls and password-access systems.  We use the Secure Sockets Layer (“SSL”) certificates for transmission of private data over a secure Internet connection.  We have obtained and regularly update industry-standard anti-virus software.  Only authorized individuals have the right to access or disclose information you provide to us.  We block attempted logins after multiple incorrect attempts.

We make every reasonable attempt to protect the personally identifiable information you share with us, but no transmission over the Internet is ever 100% secure, and no information stored electronically is ever 100% immune from attack, so we cannot guarantee or warrant the security of information you choose to provide to us.

What rights you have over your information

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we update or delete any personal data we hold about you (other than any data we are required to keep for legal, administrative, or security purposes).

Our communications with you will include information about how to opt out if you wish to do so.  E-mail opt-out requests will be processed within 10 business days.  Requests received through U.S. mail may take longer to process.

California residents’ privacy rights

If you are a California resident, California Civil Code § 1798.83 provides that you may request information from us once a year on the sharing of your personal information with third parties for their marketing purposes, including the companies with which we shared the information and the type of information shared.  You may also request that we not share your personal information with other parties.  To do this, please contact us by fax at 704-909-4501 or by U.S. mail at: Chipper Fox, LLC, c/o Morgan Capital Management 13024 Ballantyne Corporate Place, Unit 500, Charlotte NC 28277.  We will respond to you within 30 days by U.S. mail.
